Terms of Service

By accessing or using MadProps ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

MadProps is an AI-powered scene and prop generation tool. Users can upload scene images or generate them with AI, then create, edit, and place props within those scenes. The Service uses third-party generative AI models (including Google Gemini) and image processing providers (including PhotoRoom) to produce derivative content based on your inputs.

You retain ownership of the images you upload and the content you create using MadProps, subject to the following conditions:

• Ownership & Permission: By uploading any image (scene, battlemap reference, or style guide), you represent and warrant that you own the image or have obtained all necessary rights, licenses, and permissions from the rightful owner to upload, process, and use the image through the Service. You may not upload images to which you do not hold sufficient rights.
• Liability for Copyrighted Material: You accept full responsibility and liability for any image you upload that contains copyrighted material, including but not limited to copyrighted characters, logos, trademarks, or artwork belonging to third parties. MadProps is not responsible for verifying the copyright status of uploaded content, and you agree to indemnify and hold MadProps harmless from any claims, damages, or legal actions arising from your upload or use of such material.
• Generated Output: AI-generated scenes and props are derivative of the prompts, references, and images you provide. Your rights to use, share, or distribute these outputs depend on your rights to the original input material.
• No Warranty of Non-Infringement: MadProps does not guarantee that any content generated by the Service is free from third-party intellectual property claims. You are solely responsible for evaluating and ensuring the legality of your use of generated content.
• Automated Commercial-Map Screening: When you upload a battlemap reference, MadProps automatically screens it for publisher logos, artist watermarks, copyright text, and other commercial-product markings. MadProps also screens AI prompt text and rejects prompts that reference commercial map or asset creators by name or ask for output "in the style of" such creators (the blocklist is maintained by MadProps and updated over time). When either screen triggers, the request is rejected and no credits are charged. This screening is a best-effort safeguard, not a substitute for your obligation to have the rights to the content you upload, and MadProps is not liable for material or prompts that bypass the screening.

When you export, download, or share scenes, props, or composites created with MadProps, you additionally attest that:

• You have the right to use and distribute the underlying reference artwork
• The shared content does not infringe on any third party's intellectual property rights
• You have permission from any original artist (if applicable) to create and share derivative works

Images generated by MadProps using Google's Gemini image models contain an invisible digital watermark (Google SynthID) that identifies them as AI-generated. By using the Service, you acknowledge and accept that:

• AI-generated images may be permanently watermarked using SynthID technology
• The watermark is invisible to the human eye and does not affect image quality
• The watermark is designed to be non-removable and resilient to common transformations
• You may not attempt to remove, obscure, or circumvent the SynthID watermark
• You may not misrepresent AI-generated images as entirely human-created works

Do not upload sensitive or personal images you wish to keep private. While we take reasonable measures to protect your data, images uploaded to the Service may be transmitted to and processed by third-party AI providers. See our Privacy Policy for details.

MadProps reserves the right to suspend or permanently terminate your account at our sole discretion, including for violations of these Terms, the Acceptable Use Policy, or applicable laws.

MadProps is provided "as is" without warranties of any kind. To the fullest extent permitted by law, MadProps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

You agree to indemnify, defend, and hold harmless MadProps and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. When the agreement materially changes, we will ask you to re-accept the new version the next time you upload an image.
